Abstract
Education and care of the child is the natural right of parents. On the other hand there exist obligations of the State (sentinel function by the state, the so-called "staatliches Wachteramt") for the well-being of the child in order to prevent substantial endangerment of the child by parents or third parties. The constitutional obligation for protection of children is fulfilled by the legislator with regulations in the family rights of the Civil Code (BGB) and the Social Legislation (SGB) VIII - child and juvenile welfare service. In recent years numerous amendments were made in these laws. This article describes relevant standards from these fields of law and the cooperation of the youth welfare office, family court and expert consultant as a responsible communal body.
