Abstract:
The German Criminal Code (StGB) contains different penal provisions which serve to punish maltreatment and violence against children and adolescents. This article deals with offences against life with violence and maltreatment against children by parents and other persons associated with the child. Relevant norms of the 16th chapter (criminal offences against life) and 17th chapter (bodily harm with fatal consequences) will be described and the practical use will be clarified with current examples from the jurisdiction. The decisions of appellate jurisdiction of the Federal High Court (BGH) gathered from different legal data bases from the years 2008 and 2009 concerning criminal offences against the life of a child (21 BGH decisions) will be discussed. Errors during the consideration of evidence as well as legal considerations of the first instance are pointed out. Difficulties of the legal considerations in the context of crimes involving physical injury are discussed.
